Effective upon acknowledgment.
By acknowledging this agreement and continuing to use Can I Dine?™ for menu publication, the participating restaurant ("Partner") agrees to the following:
Partner is solely responsible for the accuracy, completeness and timeliness of all dish names, ingredients, sauces, allergens, modification notes, cross-contact disclosures, cooking-oil disclosures and any other menu information published through Can I Dine?™. Partner represents that the menu information it submits is true to the best of its knowledge.
Partner agrees to disclose known cross-contact risks (shared fryers, shared surfaces, shared utensils) and the type(s) of cooking oil used so that diners with allergies and dietary restrictions can make informed decisions.
Partner agrees to keep menus current. If a recipe, supplier, ingredient or preparation method changes, Partner will promptly update the corresponding entries in Can I Dine?™.
Partner acknowledges that Can I Dine?™ does not prepare food, inspect kitchens, audit suppliers, test ingredients, or verify allergen information. Can I Dine?™ is a technology display layer for restaurant-provided information.
Partner agrees to defend, indemnify and hold harmless Can I Dine?™, its owners, officers, employees, contractors, affiliates and service providers from any third-party claims, damages, losses, liabilities and reasonable attorneys' fees arising out of (a) the accuracy or inaccuracy of menu information Partner publishes, (b) any allergic reaction, illness, injury or death suffered by any diner consuming food prepared by Partner, (c) cross-contact or cross-contamination occurring in Partner's premises, and (d) Partner's violation of any law or this Agreement.
To the maximum extent permitted by law, Can I Dine?™ is not liable for any allergic reaction, illness, injury or damages arising from food prepared by Partner or any inaccuracy in Partner-submitted information.
Partner is responsible for the conduct of any staff members it grants access to its Can I Dine?™ account, including the accuracy of edits they make.
Partner agrees to the subscription fees corresponding to its chosen plan. Plan changes take effect upon successful payment.
Either party may terminate this relationship at any time. To cancel renewal, the account owner selects Cancel subscription in the dashboard, reviews the cancellation notice, and completes cancellation in Stripe. Cancellation takes effect at the end of the current billing period; it does not erase amounts already owed.
After the subscription ends, the QR menu remains accessible for 7 days. After those 7 days, scanning the QR code opens an unavailable-menu notice instead of the menu. The public directory listing may be removed when the subscription ends.
Saved menus, recipes, and associated menu records are retained for 30 days total after the subscription ends, including the 7 days of QR-menu access. Unless the subscription is reactivated before that deadline, those records are automatically deleted from the live service by the scheduled cleanup, normally within one hour after the deadline. Deleted menus cannot be restored through the service; restarting afterward requires uploading a new menu. Account login remains available for billing and account management. Failed or unpaid subscriptions also have a 7-day access grace period and a 30-day menu-retention window; deletion is deferred if current billing status cannot be verified.
The owner can instead use Settings → Delete account to request immediate account and restaurant-data deletion, after any linked subscription is canceled successfully. Billing and transaction records may be retained for legal and accounting purposes. Backup copies follow the hosting providers' backup lifecycle and are not available through the live service.
This Agreement is governed by the laws of the State of Wyoming.
